13. Force majeure

If the event continues for more than 60 days, either party may cancel the affected order and we will refund any amount paid for that order, with no further liability.

19. Governing law and dispute resolution

Any dispute, controversy, or claim arising out of or in connection with these Terms, the website, or any order will first be attempted to be resolved amicably through good-faith discussions. If the dispute is not resolved within 30 days of written notice from one party to the other, the dispute will be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended from time to time).

•       The arbitration will be conducted by a sole arbitrator appointed by mutual agreement of the parties. If the parties fail to agree on a sole arbitrator within 15 days, the arbitrator will be appointed in accordance with the Arbitration and Conciliation Act, 1996.

•       The seat and venue of arbitration shall be Gurgaon, Haryana, India.

•       The language of arbitration shall be English.

•       The arbitral award shall be final and binding on the parties.

Subject to the arbitration clause above, the courts at Gurgaon, Haryana shall have exclusive jurisdiction over any matter not capable of being resolved by arbitration.
